Zoning - Ordinance No. 745
AN ORDINANCE AMENDING ORDINANCE #326 OF THE ORDINANCES OF THE CITY OF EASTBOROUGH , KANSAS, BY SETTING FORTH THE RULES AND REGULATIONS REGARDING THE BUILDING, LOCATION AND MAINTENANCE OF FENCES WITHIN THE CITY OF EASTBOROUGH, KANSAS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EASTBOROUGH, KANSAS:
That Ordinance #326 of the ordinances of the City of Eastborough, Kansas, be amended by adding thereto a new provision to Section 3 "Area Regulations" which shall be known as 3 (2) (s) which shall provide as follows:
(s)- No fence of any kind will be built or maintained on any public property, specifically including but not limited to any portion of the right of way of streets adjoining any lots.
- No fences or similar structures of any kind which exceed 36 inches in height shall be constructed or maintained closer to the street than the front building setback line permitted and controlled by the zoning laws of the City of Eastborough, Kansas. If a house is located on a corner lot at the intersection of any two streets, then the above restriction applies to the front and side yard setback restrictions in the zoning ordinance of the City of Eastborough, Kansas, as it applies to both streets.
- There shall be no restrictions regarding the building and maintenance of fences on any part of any lot other than the restrictions set forth above except that if any fence is placed on, over or above any public utility right of way (such as the right of way for sewer lines) and it becomes necessary to move or remove the fence in the maintenance or service of said public utility, then the lot owner shall pay any expense of the moving or removing of said fence.
This ordinance shall take effect and be in force from and after its final publication in the official newspaper of said municipality.
