
AN ORDINANCE RELATING TO THE PREVENTION OF FIRES, AND PROVIDING PENALTIES FOR THE VIOLATION OF THE TERMS HEREOF.
BE IT ORDAINED BY THE COUNCILMEN OF THE CITY OF EASTBOROUGH, KANSAS:
Section 1: It shall be unlawful for any person to burn papers, trash, shavings, weeds, brush, grass, leaves or other combustible material unless said material is burned in a trash burner made of brick, concrete or metal, with heavy close mesh screen covers, such mesh to be not more than one half (1/2) inch mesh, which burner shall not permit burning material to be scattered or blown about by the wind.
Provided Further, that the use of metal trash burners shall not be construed to include trash burners made of woven or welded wire, unless of a type of construction which shall be approved by the Fire Marshal of the State of Kansas: has one that will prevent the wind from scattering burning embers.
Provided Further, that nothing shall be burned in such a manner which will cause damage to the property of other persons living within said city.
Section 2: Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction shall be fined the sum of $25.00 and shall be liable to the City of Eastborough for the cost any fire runs occasioned by the violation of such ordinance.
Ordinance effective from and after its publication once in the official city paper.
